This agreement formalises electronic acceptance of the PokéHunt terms and defines how digital acceptance, technical records, versions, the account, responsibility and limitations are handled.

Introduction and Nature of Acceptance

This agreement formalises the user’s electronic acceptance of the PokéHunt terms.

1.1. Electronic acceptance agreement

This Electronic Acceptance Agreement sets out the conditions under which the user accepts, by digital means, the terms governing access to the website, client, account, game, store, support, social systems and other services related to PokéHunt.

1.2. No individual negotiation

The clauses of this agreement are presented in standard form to every user. The user cannot individually change the content of the terms. If you do not agree with any condition, you must stop the sign-up, not access the game and not use PokéHunt services.

1.3. Incorporated documents

Electronic acceptance covers this agreement, the PokéHunt Service Agreement, the PokéHunt Extended Agreement where donations are involved, the PokéHunt Rules, the Cookie Policy, the Privacy Policy, checkout notices and terms shown at sign-up, login, in the client, in support or on other official channels.

Forms of Acceptance

Acceptance may occur through a positive action, continued use or digital contracting.

2.1. Acceptance by click or equivalent action

The user electronically accepts the terms by ticking an acceptance box, clicking a confirmation button, creating an account, logging in, accessing the game, using the client, completing checkout, activating a benefit, spending Safira, opening a ticket, taking part in game systems or performing an equivalent act of using the services.

2.2. Continued use

Continued access to PokéHunt after the terms are made available or updated indicates awareness of and agreement with the version in force. If the user disagrees with a future change, they must stop using the services and, where applicable, request the available measures for closing or handling the account.

2.3. Users under 18

Users under 18 should only accept this agreement, create an account, access the game or make donations with the knowledge and authorisation of their parents or legal guardians. The legal guardian must supervise use, payments, interactions and account security.

2.4. Acceptance on behalf of third parties

By accepting this agreement on behalf of a company, a legal guardian, a payment holder or an authorised third party, the user declares that they hold sufficient powers to assume obligations on behalf of the person or entity represented. False declarations may result in blocking, reversal, account termination and any applicable measures.

Legal Validity and Proof of Acceptance

PokéHunt may keep technical records to demonstrate authorship, integrity and the moment of acceptance.

3.1. Validity of the electronic means

The user acknowledges the validity of electronic acceptance, including by click, authentication, donation confirmation, continued use or another digital mechanism accepted by the parties, provided there is no specific legal requirement of a different form for the act performed.

3.2. Acceptance records

For security, auditing, fraud prevention and contractual evidence, PokéHunt may record the date, time, IP, account identifier, e-mail, version of the terms, sign-up event, login event, checkout confirmation, device, browser, session and other technical evidence associated with the acceptance.

3.3. Version integrity

PokéHunt may keep a version history of the legal documents, hashes, logs, snapshots, backups, metadata and publication records to prove which version was available or was accepted at a given moment.

3.4. Challenging the acceptance

If the user claims not to have accepted the terms, or alleges misuse of the account, an unrecognised payment or access by a third party, the team may analyse technical records, authentication history, transactions, tickets, devices, IPs, WebSocket/API events and other available evidence in order to decide on security, corrective or termination measures.

Account, Authentication and Responsibility

Electronic acceptance is tied to the account and to the actions taken through it.

4.1. Responsibility for the account

The user is responsible for keeping their e-mail, password, session, token, recovery key, device, browser, network and other means of authentication protected. Actions taken through the account may be attributed to its holder when they arise from sharing, negligence, sale, lending, a compromised device or a lack of adequate protection.

4.2. Prohibition of sharing

It is prohibited to share, sell, rent, lend or transfer credentials, the account, a character, a session, access, a token or means of authentication. Sharing increases the risk of loss, fraud, a ban, reversal of benefits and the impossibility of recovery.

4.3. Reporting a compromise

Suspicions of intrusion, account theft, misuse of payment, unauthorised access, phishing or credential leaks must be reported to official support immediately. Delay may reduce the chance of preserving evidence, recovering the account, blocking access or reversing damage.

Availability, Risks and Disclaimer of Warranties

PokéHunt is an evolving online service, subject to technical failures, maintenance and changes.

5.1. Service as is

PokéHunt is provided as is, with no guarantee of continuous operation, complete absence of errors, absence of vulnerabilities, permanent compatibility, availability of every feature or the unchanged preservation of formulas, benefits, items, the economy, rankings, characters and systems.

5.2. Maintenance and changes

Maintenance, deploys, updates, fixes, balancing, events, gameplay changes, store changes, economy adjustments, emergency blocks and rollbacks may occur to protect the game, fix failures, prevent abuse or improve the service.

5.3. Events outside our control

PokéHunt will not be liable for unavailability or damage caused by failures of the internet, the user’s devices, providers, data centres, payment platforms, third-party attacks, DDoS, malware, unavailability of external services, force majeure or other factors outside its reasonable control.

Limitation of Liability

Liability will be assessed under applicable law, the origin of the damage and the available evidence.

6.1. In-game losses

To the fullest extent permitted by applicable law, PokéHunt will not be liable for loss of progress, items, gold, characters, ranking, benefits, Safira, play time, opportunity, expected profit or virtual advantage arising from an error, maintenance, a rollback, balancing, a penalty, a breach of the rules or misuse of the account.

6.2. Indirect damages

PokéHunt will not be liable for indirect, special, incidental, punitive or consequential damages, lost profits or lost opportunity arising from the use, unavailability, suspension, change, termination or inability to use the services, subject to non-waivable rights provided by law.

6.3. Good faith and proportionate correction

Where there is a proven failure attributable to PokéHunt, the remedy may involve technical correction, reprocessing, restoration, reversal, credit, proportionate compensation or another measure appropriate to the case, according to technical feasibility, the available evidence and applicable law.

Changes to the Agreement

The version in force will be available in the legal center and may be updated as the service evolves.

7.1. Updates

This Electronic Acceptance Agreement may be updated to reflect changes in product, security, operations, payments, legislation, regulatory requirements, abuse prevention or business decisions. The version in force will be available in the PokéHunt legal center.

7.2. Notice of changes

PokéHunt may announce changes through the website, the legal center, the login screen, the client, checkout, the registered e-mail, support or official channels. Continued use after publication indicates awareness and acceptance of the updated version, except where the law requires a specific procedure.

7.3. Conflicting versions

If versions conflict, the version in force published in the legal center prevails for facts occurring after it takes effect. For earlier facts, PokéHunt may consider the version accepted, the available logs, the notices displayed and the specific documents of that period.

Final Provisions

This agreement confirms the effectiveness of digital acceptance and preserves mandatory rights provided by law.

8.1. Governing law

This agreement will be interpreted under Brazilian law, including civil, consumer, internet, data protection and electronic signature rules where applicable. Non-waivable rights of the consumer and of the data subject will be preserved.

8.2. Partial invalidity

If any clause is held invalid, unenforceable or inapplicable, the remaining clauses will remain valid to the fullest extent permitted by applicable law, preserving the economic, operational and legal intent of the agreement.

8.3. Final acknowledgement

By accepting electronically, creating an account, logging in, using the game, completing checkout or continuing to use PokéHunt, the user acknowledges that this instrument has legal effect consistent with digital contracting and confirms their obligation to comply with the applicable official terms.
